1. Who we are

The website at tradidoll.com (the “Site”) and the TradiDoll software (the “Software”) are published by Osange Kft., a company registered in Hungary under number 13-09-112283, with its registered office at H-2114 Valko, szabadsag ut 88, tax number 13921947-2-13 (“we”, “us”).

2. These terms

These terms govern your use of the Site, the Software and any subscription. By creating an account, downloading the Software or subscribing, you accept them. If you do not accept them, do not use the Site or the Software.

3. What TradiDoll is

3.1 The Software is a desktop application that helps you run grid-trading strategies on your own eToro account. It connects to eToro directly from your computer, using API keys that you create on eToro and enter in the Software. It may also download reference data published on tradidoll.com, such as market trading hours, and news feeds: by default those of the U.S. Bureau of Labor Statistics, and any you choose to add.

3.2 It exists in two builds: tradidoll-demo, which works only with your eToro demo (virtual) account and is free of charge; and tradidoll-real, which works with your eToro real account and is available to subscribers.

3.3 The Software proposes actions. Nothing is sent to eToro unless you approve it, or unless you have yourself enabled the settings that approve and send tasks automatically. You are responsible for the settings you choose and for their consequences.

4. Not investment advice; trading risk

4.1 TradiDoll is a software tool. Nothing on the Site or in the Software is investment, financial, legal or tax advice, a recommendation, or an offer to buy or sell any financial instrument.

4.2 Trading carries a substantial risk of loss, all the more with leverage: you can lose some or all of the money you trade. Past performance does not predict future results. The Software’s simulations replay past prices; they may differ from what would actually have happened, and they do not predict what will happen.

4.3 You alone decide which strategies, limits and settings to use and which proposals to approve, and you alone bear the results.

5. eToro

5.1 We are not affiliated with, endorsed or sponsored by eToro. “eToro” is a trademark of its owner.

5.2 Your eToro account, and every order placed on it, is governed by your agreement with eToro. We have no control over eToro’s platform, its API, prices, fees, availability, limits or changes, and we are not responsible for them.

5.3 You are responsible for creating your API keys with appropriate permissions, for keeping them secret, and for revoking them on eToro if you suspect they have been compromised. If you choose to save them to disk, the Software stores them unencrypted on your computer.

6. Your account on the Site

You must be at least 18 years old and give accurate information. Keep your password confidential: you are responsible for what is done with your account. An account is personal and may not be shared.

7. Subscriptions

7.1 Prices are shown on the pricing page. Subscriptions are sold and billed through Stripe Managed Payments, under which Stripe acts as merchant of record for the transaction: the payment, invoicing, taxes and refunds are handled by Stripe, under the terms presented at checkout.

7.2 A subscription paid through Stripe renews automatically at the end of each billing period, monthly or yearly, until it is cancelled. We will give you at least 30 days’ notice of any price change, which will apply from your next renewal.

7.3 You may cancel at any time by writing to us or through the subscription management offered with your receipt. Cancellation takes effect at the end of the current billing period, and you keep access until then.

7.4 If you are a consumer in the European Union or the United Kingdom, you may withdraw from a subscription within 14 days of purchase without giving a reason, as provided by applicable law. During that period, tradidoll-real is made available for download only once you have expressly asked for it to be supplied immediately and acknowledged that you then lose your right of withdrawal. You lose that right once you have downloaded it, to the extent applicable law allows. If you prefer to keep it, you can wait until the 14 days are over.

7.5 When a subscription ends, access to tradidoll-real on the Site ends with it.

7.6 Where PayPal is offered as a payment method, the seller is Osange Kft., and PayPal processes the payment under its own terms. The price shown includes taxes. A PayPal payment gives access to tradidoll-real for one month or one year, as chosen; it does not renew automatically. We activate your access by hand once your payment has reached us and has been matched to your account; access then ends at the end of the period paid for. Sections 7.4 and 7.5 apply to these payments as well.

8. Licence

8.1 Subject to these terms, we grant you a personal, non-exclusive, non-transferable and revocable licence to install and use the Software on computers you own or control, for your own trading: tradidoll-demo free of charge, and tradidoll-real while your subscription is active.

8.2 You may not copy the Software except as needed to install and use it, distribute, sell, rent, lend or sublicense it, make it available to others, modify it or create derivative works from it, or reverse engineer, decompile or disassemble it, except to the extent the law expressly allows. You may not use it in breach of eToro’s terms or of the law.

8.3 The Site and the Software, and all intellectual property rights in them, remain ours or our licensors’. Third-party components included in the Software are licensed under their own terms, which are provided with it.

9. Changes and availability

We may update, change or discontinue the Site or the Software at any time. We do not guarantee that the Site will always be available, or that the Software will keep working with future changes to eToro’s platform or API.

10. No warranty

To the fullest extent permitted by law, the Site and the Software are provided “as is” and “as available”, without warranty of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose, accuracy or non-infringement, and without any warranty that they will be uninterrupted, error-free or secure, or that they will produce any particular result or profit.

If you are a consumer, this clause does not affect the statutory rights you have regarding the conformity of digital content and services, which cannot be excluded.

11. Limitation of liability

11.1 To the fullest extent permitted by law, we are not liable for trading losses or for any loss resulting from orders placed on your eToro account; for loss of profit, revenue, data or opportunity; for any indirect or consequential loss; or for loss caused by eToro, by your computer or network, by the use of your API keys, or by the settings you chose and the proposals you approved.

11.2 To the fullest extent permitted by law, our total liability arising out of these terms or of your use of the Site and the Software is limited to the amount you paid for your subscription in the twelve months before the event giving rise to the claim.

11.3 Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, including liability for intentional misconduct or gross negligence, for death or personal injury, or your statutory rights as a consumer.

12. Suspension and termination

We may suspend or close your account if you breach these terms or use the Site or the Software unlawfully. You may close your account at any time by writing to us. When your account is closed, your licence to tradidoll-real ends; sections 4, 5, 10, 11 and 14 continue to apply.

13. Changes to these terms

We may change these terms. We will publish the new version here with its date and, for material changes, inform subscribers by e-mail beforehand. If you do not accept the new terms, you may cancel your subscription before they take effect.

14. Governing law and disputes

These terms are governed by Hungarian law. If you are a consumer, you also keep the protection of the mandatory provisions of the law of your country of residence, and you may bring proceedings before the courts of that country. Otherwise, the competent courts of Hungary have jurisdiction.
